Agreement Overview
These Terms and Conditions ("Terms") govern your use of Buy Your Watch's services and website. By using our services, you agree to be bound by these Terms. We are a luxury watch purchasing service that provides fair valuations and secure transactions for watch sellers.
Our services include watch evaluation, authentication, pricing, and purchase. We maintain strict standards for authenticity and condition assessment to ensure fair transactions for all parties.
Service Description
Watch Purchasing Process
- Initial online assessment based on provided information and photos
- Physical inspection and authentication upon receipt
- Final price determination based on actual condition and authenticity
- Payment processing upon agreement
Evaluation Criteria
Watch valuations are based on brand, model, age, condition, authenticity, market demand, and presence of original documentation and packaging. Preliminary quotes are estimates and final prices may vary after physical inspection.
Minimum Purchase Value
We purchase watches with an assessed value of $20,000 AUD or more. You may submit a watch you believe is below this figure, but we may decline to make an offer. This minimum applies to outright purchases only and does not apply to loans against watches, which have their own terms below.
User Obligations
Accurate Information
You must provide accurate, complete, and truthful information about your watch, including its condition, authenticity, modifications, and any known defects or issues.
Legal Ownership
You warrant that you are the legal owner of the watch and have the right to sell it. The watch must not be stolen, counterfeit, or subject to any liens or encumbrances.
Shipping and Insurance
When shipping watches for evaluation, you must use appropriate packaging and insurance. We recommend using tracked, insured shipping methods and will provide guidance on secure shipping.
Payment Terms
Payment Processing
Payment is processed once watch authentication and verification are complete. Once our certified experts authenticate your watch and confirm its condition, payment is sent by Osko bank transfer, typically within 24 to 48 hours of your submission.
Price Adjustments
If the physical inspection reveals conditions not disclosed in the initial submission, we reserve the right to adjust the final offer. You have the right to accept the revised offer or have your watch returned at our expense.
Transaction Fees
There are no fees charged to sellers for our evaluation or standard payment processing. Any expedited payment options may include additional fees which will be clearly disclosed.
Liability and Disclaimers
Service Limitations
While we strive for accurate evaluations, watch values can fluctuate due to market conditions. Our assessments are professional opinions based on current market knowledge and may not reflect future value changes.
Shipping Responsibility
We are not liable for damage or loss during shipping to our facility unless we have specifically arranged and paid for the shipping. All items should be adequately insured during transit.
Authentication Process
Our authentication process follows industry standards, but no authentication is 100% guaranteed. We reserve the right to decline purchase of any item that fails our authentication criteria.
Dispute Resolution
Communication First
We encourage direct communication to resolve any concerns. Our customer service team is available to address questions about evaluations, payments, or other service-related matters.
Governing Law
These Terms are governed by Australian law. Any disputes will be subject to the jurisdiction of Australian courts, with preference for mediation before litigation.
No Cooling-off Period
All transactions are final upon completion of authentication and payment processing. There is no cooling-off period once payment has been made. Please ensure you are committed to the sale before submitting your watch for evaluation.
Loans Against Watches
The following terms apply where we advance funds to you secured against a watch, rather than purchasing it. This is a pawn transaction, provided under our Second-Hand Dealer and Pawnbroker Licence No. SHD-0017882. The terms above that relate to purchasing a watch do not apply to a loan.
Ownership and Security
You retain ownership of the watch for the term of the loan. The watch is held by us as security. You must be the legal owner of the watch, and it must be free of any other security interest, finance or encumbrance. You will be asked to confirm this in writing before funds are released.
Fees and Interest
A one-off setup fee of $400 covers authentication of the watch and insured storage for the term of the loan. Interest starts from 4% per month and is set following assessment of the watch, the amount advanced and the risk of the loan. Your exact rate, the amount advanced, the term and the total amount repayable are confirmed to you in writing before any funds are released. You are under no obligation to proceed at any point before accepting those terms.
Redemption and Early Repayment
You may redeem the watch at any time during the term by repaying the amount advanced together with the setup fee and the interest for the full term, less any interest already paid. Loans are written for a fixed term, so redeeming early returns your watch sooner but does not reduce the interest payable. The watch is returned to you once cleared funds are received, either in person or by insured delivery.
Default, Sale and Residual Equity
If the loan is not repaid in full by the end of the agreed term, the debt is discharged in full. We have no further claim against you for any shortfall, we do not pursue you for the balance, and the transaction is not reported to any credit reporting body. The watch is our sole recourse.
Once the loan period expires we offer the watch for sale at the best price reasonably obtainable, as soon as practicable. If the sale price exceeds the outstanding amount of the loan plus the reasonable costs of sale, the difference is your residual equity. You may claim it from us on demand at any time within 12 months of the sale, and we will pay it to you. This reflects section 23A of the Second-Hand Dealers and Pawnbrokers Act 1989 (Vic).
Storage and Insurance
For the term of the loan the watch is held in secure storage and insured against loss, theft and damage. We are responsible for the watch while it is in our possession. The watch is not worn, used, sold or offered for sale during the term.
Authentication
All watches are authenticated by certified watchmakers before funds are advanced. If a watch is found not to be genuine, or materially different from what was described, no loan is made and the watch is returned to you. We may decline any application without giving reasons.
Governing Law
Loans are governed by Australian law, including the applicable state legislation governing second-hand dealers and pawnbrokers, and are subject to the jurisdiction of Australian courts.

We may update these Terms periodically. Significant changes will be communicated to users with active transactions. Continued use of our services constitutes acceptance of updated Terms.
